TERMS AND CONDITIONS

Vayu Travel Cloth Private Limited (hereinafter referred to as “we”, “our”, “us” or “Vayu Travel Cloth Pvt. Ltd” or “Travel Cloth”)is a company incorporated under the Companies Act, 2013 and includes our branches, their respective employees, agents, independent contractors, affiliates and assigns. We are the owners and operators of this Website/Mobile App providing services that assist in the luggage management of customers by offering logistic services to such customers (“Services”). These terms apply to your use of this Website/Mobile App and our Services. Please take a few minutes to read these terms carefully before you use our Website/ Mobile App and our Services. If the Booking (as defined below) was made on your behalf by a third party, your continued use of our Services means you agree to these Terms and Conditions.

These Terms and Conditions constitute a legally binding agreement between you and Vayu Travel Cloth Pvt. Ltd. Any reference to the term “you” or “your” shall mean to include any person using, accessing or availing the Services offered through the Website/Mobile App. You accept these Terms and Conditions each time you access and use the Website/Mobile App. If you do not accept these Terms and Conditions, please do not use our Services or access our Website/Mobile App any further.

1. DEFINITIONS

“"Booking and/or Order" means a Customer’s request for Services through our Website/ Mobile App as evidenced by our records. “Mobile App/Website or Website/Mobile App” means and includes domains, mobile applications (downloadable from Android, Windows, and Apple devices) owned by Vayu Travel Cloth Pvt. Ltd. "Charges" means the fees, charges, and amounts assessed or levied for movement of any Luggage from the origin to the destination in accordance with these conditions or any conditions or fees subsequently imposed as per the rate card provided in the Website/ Mobile App as per the type, size and weight of Luggage.

"Consignment Number and /or Order Number" means the number issued by us to a Customer ensuring account activity is summarised by the Travel Cloth tracking system to find out the status of the Luggage of the Customer who has signed for it. "Customer" and/or “user” and/or “you” means the person who makes a Booking (whether directly or indirectly for other person/alliance partners) through our Website/ Mobile App.

“Pick-up Address” and “Delivery Address”, wherever used, shall be the location within India designated by you for the pick-up and drop of your Luggage respectively on the Website/Mobile App at the time of Booking and validated by us as willing to accept the delivery of the Luggage on terms acceptable to us.

“Force Majeure Events' ' shall mean any cause beyond Travel Cloth’s reasonable control including, but without being limited to Acts of God, terrorism, political riot or disturbance, governmental regulations, invasion, war, threat or preparation for war, storm, flood, epidemic or natural physical disaster.

“Order Modification” means or includes or takes place during the following situation:

  • The Customer's Luggage is not classified correctly;
  • Weight of the Luggage measured by our personnel at the time of pick up does not match with the online order placed by the Customer;
  • There is an addition or subtraction of Luggage count to the order placed by the Customer.
  • Insurance payable towards increased Luggage count in the Order by the Customer. Applicable only if the Customer has opted to buy additional insurance in the Order placed.
  • There is variation in the rate of Order due to the current ‘offer/coupon applied’ to the Order because of Order modification.

"Luggage" means any parcel(s) which is owned or booked by a Customer and accepted and transported by us pursuant to these Terms and Conditions and does not include any explosives/harmful goods or such other goods which are prohibited and that are perishable and dangerous/prohibited to carry as detailed in the following link modified from time to time: http://www.iata.org/publications/dgr/Pages/index.aspx

“Prohibited Items” means any items which are potentially dangerous in nature, items the possession of which is illegal in India, livestock, foodstuffs, and perishable items or such other goods which are prohibited and that are perishable and dangerous/prohibited to carry as detailed in the following link modified from time to time: http://www.iata.org/publications/dgr/Pages/index.aspx

“Reschedule Delivery” means a request by the user to deliver the Luggage to a different location or time after being ‘picked up’ by us with a reasonable notice period subject to additional charges communicated over a phone or email to customer.

“Scheduled Customer Drop-off Time” means the scheduled time for the drop-off of the Luggage by the Customer to us as set out in the Booking;

“Scheduled Delivery Time” means the scheduled time for delivery of the Luggage to the Delivery Address as set out in the Booking;

“Sealed Luggage” means a Luggage which has been approved as locked by the Customer and sealed using a tamper-resistant bag by our representative and registered by us or one of our agents at the time of collection from the Customer in accordance with our security procedures from time to time;

2. USE OF MOBILE APP/WEBSITE:

The Services constitute a technological platform through a Mobile App/ Website which allows you to avail efficient logistic services eliminating your Luggage management problems. Mobile App/Website is provided solely for the use of current and potential customers to interact with us and may not be used by any other person or entity, or for any other purpose. Specifically, all tracking, rating, receiving invoices and remitting payment using electronic funds transfer, drop-off location, identifying and preparing Luggage, estimating duties and taxes, and other information and services may only be used by current and potential Mobile App/Website Customers for their own Orders.We are merely providing support functions to our Customers and you hereby agree and acknowledge that this Mobile App/Website is strictly for your personal and confidential use. Abuse or misuse of the Mobile App/Website, including gaining or attempting to gain unauthorised access to the Mobile App/ Website or circumvent the security of the Mobile App/Website in any manner is strictly prohibited. The use of automated dial-in or inquiry devices to obtain information through any of our communication support units is strictly prohibited. Travel Cloth or its entities shall not accept ideas, concepts, or techniques for new services or products through its Mobile App/Website. If such information is received, it will not be considered confidential and we will be deemed free to use, communicate, and exploit such information in any manner it chooses.

3. HOW TO BECOME A REGISTERED USER:

  • To avail our Services, one should be a registered user.
  • If you choose to become a registered user, you will have to provide all the necessary information and valid proofs. Id proof is not mandatory for registration of a user, it can be uploaded later or uploaded now. An Order can be picked up only after inspecting the valid Id proof.
  • The Id proof, if uploaded should be a clear image/file. Email/SMS notification will be sent to the registered email address if the user details are not of a match to the details provided in registration form. Make sure the Id proof is clear on the fields of name, date of birth and address. The user address entered during registration does not have to match the address in Id proof.
  • When you register using Mobile App/Website Login Registration, your mobile number will be the user ID. One-time password (OTP) will be sent to the registered mobile number as password to login. You must treat such a user ID. You will be asked to enter OTP every time you try to login to your account., and you must not disclose it to any other person or entity. You are responsible for all activities that occur under your account and user ID.You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your password or other security information. You agree to notify us immediately of any unauthorised access to or use of your account or any other breach of security. You also agree to ensure that you exit from your website session at the end of each visit. Further, in case you do share your user ID and password to any third parties, without keeping us informed of the same, we shall not be held liable for such third party use of your account.
  • We have the right to disable any username or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have breached any provision of these Terms and Conditions.
  • Each email address and contact mobile phone number can only be associated with one Travel Cloth account.
  • Auto registrations are also available for Booking made directly with Travel Cloth via phone.
  • There is no fee for registration.
  • By registering on Mobile App/Website, you agree to provide accurate and current information about yourself as prompted by the Mobile App/Website Login Registration pages and maintain and promptly update your online profile information to keep it accurate and current.
  • Our Services are being made available to Customers for travel destinations in India. The Service is currently available with 20000+ pin codes across India and selected International destinations . You agree to register only for our Services offered on the Mobile App/Website.in which your Service Order is based.

4. LOGISTIC PARTNERS TERMS & CONDITIONS

We rely on our partner company for our logistical needs as it is a partnered service. Hence by agreeing to this Term and Conditions for Travel Cloth, you also agree and abide by their terms and conditions. In the event of failure to comply with such terms and conditions of our logistic partner company, the logistic partner company reserves the right to take necessary action against you and you shall keep Travel Cloth indemnified from such claims and actions.

5. CHANGES TO VAYU TRAVEL CLOTH PRIVATE LIMITED

Our Mobile App/ Website and its Content (as defined below) may be changed,deleted, or updated at any time without notice. It shall be your responsibility to keep yourself updated of any such changes by visiting our Mobile App/ Website. Your continued use of the Mobile App/Website following any such amendment to the Terms and Conditions will signify your acceptance to any such revised Terms and Conditions.

6. TERMINATION OF USE

  • We may discontinue, suspend or modify the Mobile App/Website at any time without notice, and we may block, terminate or suspend your and any user's access to Mobile App/Website at any time for any reason in its sole discretion, even if access continues to be allowed to others. Where it is observed that there is any suspected illegal, fraudulent, indecent or abusive activity on your accord, it may amount to grounds for terminating your access to the Mobile App/Website.
  • Upon suspension or termination, we reserve the right to remove or delete your information including but not limited to login and account information and your right to the Services on the Mobile App/ Website shall immediately cease without notice.

7. OWNERSHIP

  • The Mobile App/Website and its Content absolutely and completely belongs to Travel Cloth. And therefore, Travel Cloth reserves absolute and complete rights on the Mobile App/Website and their Content.
  • The Mobile App/Website does not convey to anyone, by allowing access to our Mobile App/Website, any ownership rights in our Mobile App/Website or in any Content appearing on or made available through Mobile App/Website. Customers shall not copy, modify, translate, transmit, distribute, adapt, reproduce, de-compile, reverse engineer, or disassemble any part of Mobile App/Website or its Content.
  • All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the MobileApp/Website is owned, controlled or licensed by or to Us, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Travel Cloth.
  • Except as expressly provided in these Terms and Conditions, no part of the Mobile App/ Website and no Content shall be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including "mirroring") to any other computer, server, website or other medium for
  • You may use the information on our Services that has been made available by us for downloading from the Mobile App/Website provided you:
    • use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media; or
    • do not make any additional representations or warranties relating to such documents/ information.
    • make no modifications to any such information; or
  • All trademarks, brands, and service marks used in connection with the Mobile App/Website or Services offered are owned by Travel Cloth and are Travel Cloth’s property. Travel Cloth owns all copyrights and intellectual property rights and database rights in connection with the Services, Mobile App/Website. For use of any third party's intellectual property, you need to get permission directly from the owner of the intellectual property for any use. Third-party trademarks may appear on this Application and all rights therein are reserved to the registered owners of those trademarks.
  • You agree to abide by laws pertaining to copyright, trademark, patent, and trade secret ownership and use of intellectual property, and you shall be solely responsible for any violations of any applicable laws and for any infringements of any intellectual property rights caused by use of the Mobile App/Website.
  • You shall be responsible for any notes, messages, e-mails, photos, drawings, profiles, opinions, ideas, images, videos, audio files, or other materials or information posted or transmitted by you on the Mobile App/Website (“Posted Content”). Such Posted Content will become our property and you grant us the royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide licence to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such Posted Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Mobile App/Website and Travel Clothe’s (and its successors’ and affiliates’) business. We shall be entitled to use the Posted Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media, whether now known or hereafter devised, including the creation of derivative works that may include Posted Content. You agree that any Posted Content may be used by us in the manner that we deem fit, consistent with applicable laws and you are not entitled to any payment or other compensation for such use of Posted Content by us. Travel Cloth takes no responsibility and assumes no liability for the Posted Content that you or any other user or third party creates, stores, shares, posts or sends through the Mobile App/Website. You shall be solely responsible for your Posted Content and the consequences of posting, publishing it, or sharing it and you agree that we are only acting as a passive conduit for your online distribution and publication of your Posted Content. Notwithstanding anything contained in these Terms and Conditions, if your Posted Content violates these Terms and Conditions, you shall bear all legal responsibility and obligation for that content.

8. BOOKING, PICKUP AND DELIVERY:

  • Booking only becomes effective and binding on your acceptance of these Terms and Conditions and dispatch of an e-mail confirmation of the Booking to the Customer’s notified email address
  • We reserve the right to decline any Booking but if we do so we will send you a notice via email to that effect.
  • We do not intend to cancel your Order once we have accepted your Booking. However, if the circumstances warrant, we reserve the right to do so. In case we have reasons to believe that you are involved in any kind of nefarious or fraudulent activities or if you fail to adhere to the Terms and Conditions set forth herein, we reserve the right to cancel the transaction and to blacklist you thereby preventing you from making subsequent Orders on the Website/Mobile App.
  • In the event that the Order is cancelled by our corporate or alliance partners, the corporate or alliance partners need to be contacted for further information. We shall not be held liable for any such cancellations by our corporate or alliance partners.
  • The pickup shall stand completed only after the packaging of the Luggage has been inspected by the assigned personnel and signed by the Customer or any other point of contact as assigned/authorised by you.The Customer shall ensure that the correct Luggage is given to our assigned personnel as reflected on our Website/Mobile App and we shall not be held responsible for any loss, damage of theft of the Luggage in the event it is handed over to any other person other than the assigned personnel.
  • We do not accept Luggage beyond the dimension on our 'Luggage scale and type guide' available on the Website/Mobile App. In the event that the Luggage exceeds the dimensions provided on our Website/Mobile App, or the Luggage does not match with the specifications provided at the time of Booking or we observe any suspicious activity, or the Luggage contains any Prohibited Item, we reserve the right to cancel your Booking on such terms as it deems fit. Travel Cloth shall not be held liable for such cancellations.
  • In the event that the Slot time, location type, and address is to be changed once the Order is confirmed, a request for ‘Reschedule Delivery’ can be made on the Website/Mobile App. In the event that our assigned personnel are required to wait for more than fifteen (15) minutes at the Scheduled Customer Pick Up /Drop-off location then an additional charge of Rs 100/- for every 30  minutes will be charged to the Customer.
  • It shall be the Customer’s responsibility to give correct and complete details of the Pick-up Address and Delivery Address at the time of Booking as well as all the other details as required and keep the Luggage ready for collection as per Scheduled Customer Drop-off Time. Subject to the terms listed here, addresses will remain in your “Address Book” tab as long as you use the Mobile App/Website. If you do not use Mobile App/Website for a period of 6 months, your last addresses may be deleted. If the Mobile App is deleted, the address book will lose its data completely. The Address Book is a feature provided free of charge by us. You should maintain a back-up copy of your addresses as we will not be responsible for the loss of addresses contained in the Address Book. We may modify or terminate this feature at any time for any reason.

Delayed Luggage

We endeavour that all deliveries are made within the Scheduled Delivery Time, however we shall not be held liable for the delay in delivery of Luggage on account of incorrect or incomplete Pick-up Address and Delivery Address or on account of any other acts attributable to the Customer. Delay in the pick-up or delivery of the Luggage may be due to reasons that are beyond Travel Cloth’s (or other related entities) reasonable control including any operational error or due to distress or human error or any Force Majeure Events. The status bar on the Website/Mobile App for tracking the Luggage Indicates the position of the Order and is a mere indication. Minor delays or delays with regards to the above-mentioned reasons should not be held against Travel Cloth or its entities. For Luggage or Order which is not received, please contact customer care and report the same immediately. A report will be filed, and a copy will be given for follow-up action and insurance will be initiated independently by the Customer with the insurance company. Non-availability of any information in the Order or delay of Order reporting or delay of drop/delivery or pickup of Order due to technical malfunction of the application or interface or technology-based hack ware or virus will be taken in as distress and Travel Cloth or its representatives are not liable. All reimbursements are subject to insurance claim submission and process.

Lost Luggage

  • If a delayed Luggage could not be traced for 15 days from the date of report acknowledged, the same may be treated as lost. The compensation claim will be processed as per laid down procedures of the insurance taken by Travel Cloth for the Order.
  • All claims are to be made directly to the insurance provider.Travel Cloth has provided all details about the insurance under ‘Manage Orders’. All claims to be substantiated with itemised list of contents, description, age together with proof of purchase / ownership of all such items. The maximum compensation is Rs 5000. Non availability of any information. In the Order or delay of Order reporting or delay of drop/delivery or pickup of Order due to technical malfunction of the application or interface or technology-based hack ware or virus, will be taken in as distress and Travel Cloth or its representatives are not liable. All reimbursements are subject to insurance claim terms, inspection, submission and process.

Damaged Luggage

  • For Luggage, which is received in damaged or pilfered condition, please contact customer care immediately and report the same to the insurance company on the details given under ‘Manage Orders’ section. We take reasonable measures to ensure that the Luggage is delivered to you in proper condition, however you agree and acknowledge that we are merely facilitators and shall not be held liable towards any damage caused to the Luggage. Any claims made will enable the insurance company to examine the affected Luggage and assess the nature, extent and repair-ability of the damage independently. Contact with the insurance company should be made directly on the numbers listed under insurance & follow the claim procedure within 48 hours. All conversations with the insurance provider are independent of Travel Cloth. No further involvement of Travel Cloth or its representatives will be on behalf of either party for the claim made by the Booking Customer. All pictures and images pertaining to the Order can be found under ‘Manage Orders’. Non-availability of any information In the Order due to technical malfunction of the application or interface or technology-based hack ware or virus, will be taken in as distress and Travel Cloth or its representatives shall not be liable. All reimbursements are subject to insurance claim terms, inspection, submission, and process.
  • Luggage is designed to protect its content and it is the Customer or booking user’s responsibility to pack the contents appropriately. In the course of normal handling during transportation or transit or handling of moving Luggage, your Luggage will acquire evidence of use /wear and tear such as minor cuts, scratches, dents, or soil. We trust your Luggage will be able to handle/sustain the movement in handling and during transit, any spillage of contents will not be our responsibility or liability. We trust you understand that we shall have no liability for this type of damage including but not limited to
    • Broken feet/wheels or handles /straps
    • Damage to over packed/oversized bags
    • Damage due to unsuitable packing
    • Damage to pull handles / lost pull handles
    • Items of a fragile or perishable nature
    • Manufacturer/s defects
    • You may purchase additional insurance available on the Travel Cloth to obtain adequate insurance coverage through your iInsurance cCompany prior to travel.
  • Not applicable for all points on delivery/drop and pick up:
  • Passengers are advised not to carry valuables such as jewellery, en-cashable articles, negotiable papers, and currency in their Luggage and not transfer the same using Travel Cloth’s Sservices. Travel Cloth is not liable for loss/damage to or delay in the delivery of fragile or perishable articles or items of value or importance such as money, jewellery, silverware, cameras, electronics/ video/computer or photographic equipment, negotiable papers, securities, heirlooms, antiques, artefacts, work of art, irreplaceable books or publications, manuscripts, business documents, precious metals, and other similar valuables or commercial effects.

9. PRICE AND PAYMENT:

  • The price of our Services is set out in our rate card in force at the time we confirm your Booking. Our prices may change at any time, but price changes will not affect Bookings that we have confirmed with you.

    • The payment made includes all Taxes.
    • We require payment in advance for the Services at the time of the Booking. We accept payment by credit card or debit card or Internet Banking or Wallets and UPI. The availability of payment options may change from time to time.
    • You pay only for the Order upfront except for Order Modification charges or reschedule (forced or voluntary) or Orders made through phone, if they apply.
    • All Charges at the Delivery Address can be paid by debit or credit cards by the either Booking Customer or representative taking delivery. Only Booking Customers can pay the same Charges by credit card or debit card or Internet Banking or Wallets and UPI through the Mobile App/Website if activated.
    • In case of cancellation of Booking & partial refund - an email will be sent with receipt and Invoice.
    • The rate reflected on the Mobile App/Website may be different than the actual Charges for your Order at different times based on promotional offers subjected during that period. Differences may occur based on category, actual weight, dimensions, and other factors. Refer to the applicable ‘rate card’ or the rates for Order Modification details on howOrder charges are calculated.
    • Tips shall not be paid to our representatives.
    • In the event that any amount is debited from your account and not credited in our system, due to any network failure because of which the Order is not processed, such amounts usually get reversed in the same account. In this regard, we will not be responsible for delay from your bank to reverse such an amount back to your account.
    • You understand and agree that we are merely facilitators to your online payment transactions using payment gateway networks and banking infrastructure. We will not be held responsible or assume any liability in any manner whatsoever and hereby disclaim all the liabilities and claims arising out of any payment related issues as a result of your transaction including any fraud or unauthorised transactions, any issues faced by you as a result of the default/deficiency in the services by your bank, any failure in the network systems or technical glitches, decline or delay in processing any transaction

    10. YOUR RESPONSIBILITIES:

    • You agree to provide photographic ID at the collection of your Luggage from us at the Delivery Address.
    • You warrant that:
      • You have the authority to deal with the Luggage and its contents; and
      • The Luggage does not contain any Prohibited Items (as defined).
      • You acknowledge that the carrier i.e.: Travel Cloth Pvt. ltd and its representative have no knowledge of all contents of the Luggage and you hereby indemnify Travel Cloth towards all claims and charges in this regard.
      • For All the International shipments, Required documents will be submitted by customer to Travel Cloth agent as per the international shipment guidelines.
      • You endeavour to provide the correct and proper Delivery Address. However, in case you provide a wrong address, we reserve the right to cancel your Order and charge you for the same. Alternatively, we may agree to deliver the Luggage in the correct address however the same shall be subject to additional payments
      • You hereby agree and acknowledge that any information provided by you through this Mobile App/Website is true and accurate.
      • You understand and accept that by placing an Order you are essentially making an offer to us which we shall accept by way of an e-mail or SMS. You understand and acknowledge that the contact information provided by you shall be up-to-date and valid so as to enable us to provide you with regular updates regarding the status of your Order.
      • You understand that Mobile App/Website does not provide undeniable or errorless services. We hold no responsibility if the device or operating system used by you is not compatible with the Mobile App/Website and we shall not be held liable for any damage caused to You resulting in the usage of Mobile App/Website.
      • Any reviews, comments or feedback given by you on the Mobile App/Website shall be subject to checks by us and we reserve the right to take down any content or material that is illegal, defamatory, libellous, obscene, offensive, abusive, objectionable or anything that is likely to cause injury or hurt to any person or entity or violate any intellectual property of any person or entity or contains a virus. By posting the reviews, comments or any content or material on the Mobile App/Website you grant us an irrevocable licence to copy, reproduce, adapt, publish, display, create derivative works of such content across all media.
      • Do not use sharing options and SMS Alert for anything other than to communicate information about your Order. You shall not use the Travel Cloth’s messages/shares/messages/emails or any other communication received to disseminate inflammatory, infringing, obscene, or other unlawful information, or to threaten, harass, abuse, or otherwise violate the legal rights of others or perform any act contrary to law. If we or our representatives become aware of messages sent via Mobile App/Website Alert that violate these provisions, or that may damage Travel Cloth the company or its Services, we may take all actions necessary to protect ourselves, including disclosing any messages to the authorities.
      • It is not mandatory for us to send alerts for Orders for our Services made via the Mobile App/Website. We will not be liable for any failure or delay, for any reason, in the transmission, receipt, or acknowledgment of any messages sent by or to you.

      11. SECURITY ARRANGEMENTS:

      • Your Luggage shall be weighed at the location.
      • Each Luggage shall be secured in separate bags/suitcase. The bags are marked and security enabled for easy identification. Each bag will be locked with special security measures so as to prevent any loss of contents. We understand the sensitivity and safety of your Luggage and we undertake all reasonable steps to ensure the required special care and handling of your Sealed Luggage. The bags are locked and therefore the handles, trolleys and pockets will not be accessible by us. The Sealed Luggage will be opened only on delivery on request. The Sealed Luggage may incur wear and tear during transit due to wheels or other sharp items protruding or present in the Sealed Luggage. For International shipments, the custom authorities will have all the necessary rights to open the baggage for security reasons.
      • Items that come under the fragile category are carried subject to personalised inspection. In case the Booking Customer is absent at the time of pick up for the inspection of fragile Luggage item, then the inspection will be done in the presence of the person as authorised by the Booking Customer. Inspection before carriage is compulsory and the fragile item will not be picked up if the case is locked or unavailable for checking. Packing will be completed once the item is inspected before it is sealed. The item shall be further stored in a separate case to ensure safety during transit.
      • Maximum weight per Luggage is restricted to 40 Kilograms for all categories other than fragile Luggage items. The maximum height is restricted to 40 inches.
      • The Sealed Luggage bag will not be opened and/or searched by our personnel without your consent except where we are required to do so by any regulatory or governmental authority or the airport personnel.
      • We also ensure the Luggage before we cover each piece we carry. Insurance will be applied to all the Luggage counts. Insurance amount and its taxes are non-refundable for cancellations made on the date of service or otherwise. Insurance once purchased is non-refundable and non-transferable.
      • You are strongly advised against packing valuable and fragile items in your Luggage.In the event that you have selected the “Food and beverage” option on our Website/Mobile App then your Luggage can only contain food and beverage. Items that are leak-proof will be taken to be carted. Some items of value are listed below to strongly indicate the contents that are not covered under Insurance or Travel Cloth’s liability including but not limited to:
        • Laptops
        • Portable electronics
        • Any item that could be damaged or broken during transit
        • Medication
        • Silverware / precious metals / precious stones
        • Money / jewellery / other valuable items
        • Business / travel / identification documents
        • Any illegal substances or items of explosive nature
        • Items which are not leak proof
        • Inflammable items
        • Liquids
        • Perishable items etc…
      • We will keep customers updated about the transit information time by time via whatsapp/email/phone call/sms. Contact information may also be made available to the Customer of our personnel who will be delivering the Order. All other parties involved in the Booking like the location contact and passenger if they are not the same as the Booking Customer will also be able to access and view (read-only) the Booking and its changing status. We will, from time to time, send them other notifications through app/SMS/email to keep them informed of the Booking status and other information deemed required to complete the Order seamlessly.
      • Customer can download the invoice by visiting My order section or request Travel Cloth team.
      • In addition to the Mobile App/Website Terms and Conditions, the following additional terms and conditions govern the access and use of these tracking updates received from time to time on the date of service and otherwise. We authorise you to track the updates for the Order for which you are the Customer, recipient, or third-party payer and you agree to only track updates for the Order for which you are the Customer, recipient, or third-party player subject to these Terms and Conditions. You acknowledge and agree that tracking updates are the private property of VAYU TRAVEL CLOTH PRIVATE LIMITED and the same is provided to you free of charge and that any use of tracking updates information is at your sole risk. Tracking updates are provided "AS IS" and VAYU TRAVEL CLOTH PRIVATE LIMITED disclaims all warranties or conditions, express or implied.
      • In addition to our Terms and Conditions, the following terms and conditions govern your access and use of signature proof of receipt/delivery. By accessing and using signature proof of receipt/delivery, you acknowledge and agree that you are the Customer, the recipient, or third-party player, or are authorised to act on behalf of the Customer, recipient, or third-party player to retrieve the signature image for the Order you are attempting to track. You warrant and agree, on behalf of yourself and all persons on whose behalf you are acting in accessing and using signature proof of receipt/delivery, that you will not use the signature image for any purpose other than to confirm the delivery of such Order. You further acknowledge and agree, on behalf of yourself and all persons on whose behalf you are acting in accessing and using signature proof of receipt/delivery, (i) to defend (at company option), indemnify, and hold harmless us or our representatives, its parent and its parent company's subsidiary companies (collectively "VAYU TRAVEL CLOTH PRIVATE LIMITED" for purposes of this paragraph) from and against any and all claims of whatever nature arising from your access and use of signature proof of receipt/delivery, and the receipt, use and emailing of any signature retrieved; (ii) that signature proof of receipt/delivery is provided "AS IS" and you assume all risk of accessing and using signature proof of receipt/delivery; (iii) that VAYU TRAVEL CLOTH PRIVATE LIMITED DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS OF WHATEVER NATURE, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE IN RESPECT TO SIGNATURE PROOF OF RECEIPT/DELIVERY; (iv) you will only give your signature proof of receipt/delivery to the recipient or third party player of the Order you are attempting to service through us; (v) that under no circumstances shall we be liable for any money or other damages resulting from the access and use of signature proof of receipt/delivery and that the company or its representatives hereby disclaims liability for any such damage; and, (vi) that your actions and Orders are further governed by, and you will comply with, the Terms and Conditions as applicable and privacy agreement.

      11. Insurance:

      • Each Luggage in the Order is insured up to Rs.5,000/-. The sum insured is inclusive of the Luggage exterior case. We are merely facilitating insurance purchase for the Luggage in the Order on our Website/Mobile App. The insurance policy number is available under ‘Manage Orders’. All claims need to be made within 36 hours of delivery of the Order to the insurance provider directly. We are not responsible for any insurance-related matters.
      • Insurance claim procedure is listed out for online and offline services. For Any damage/loss of baggage reporting and claim the insurance, the customer requested to contact Travel Cloth Support.
      • Insurance is the subject matter of solicitation. Please refer to policy wordings for terms and conditions, coverage, and exclusions given in the insurance. Policy issued by the Insurance company.

      12. FAIR USAGE POLICY AND REFUSAL OR REJECTION OF BOOKING:

      • We reserve the right to reject or subsequently cancel Bookings where we believe there to be a misuse of our Services by you or a third party for commercial gain.
      • We reserve the right to refuse, hold, cancel, postpone or return any Booking/Order at any time if such Order would in our opinion be likely to cause damage or delay to other Orders, goods or persons, or the carriage of which is prohibited by law or is in violation of any of these Terms and Conditions.

      13. EVENTS OUTSIDE OUR CONTROL:

      • We shall not be liable for any failure to provide the Services arising from any event outside our control or action by a/any third party including:
        • Failure to meet security requirements:Travel Cloth shall not be responsible to complete Booking should the Baggage/Luggage fail to meet security requirements if additionally, screening is required we shall hand the same over to relevant authorities. The contact numbers of passengers/Customers/employees will be shared with relevant authorities.
        • Rejected delivery (incorrect details or non-acceptance) at the Pick-Up/Delivery Address;
        • national or local disruption in ground/air/water and natural calamities;
        • the actions of any regulatory or governmental authority.
        • e. Due to technical malfunction of the Mobile App/Website or interface or technology-based hack ware or virus.
        • Force Majeure events.

      14. DATA PRIVACY:

      • By accepting these Terms and Conditions, you are also agreeing that we may process information relating to you in accordance with our privacy policy, which can be found here. Our privacy policy sets out details of how we use the personal information you provide to us or we otherwise obtain about you. If you make a Booking on behalf of any other person you must draw their attention to our privacy policy and ensure that they also agree that we may process information relating to them in accordance with it and otherwise accept its terms.
      • In the event that the user ID on the Mobile App/Website is deleted, we will not delete your account or information about your account until a period of 5 years beyond which we are not obligated to retain your records. If you have any concerns, please email us at support@travelcloth.com
      • The Mobile App/Website provides you with the opportunity to grab/archive/ download/share the Order confirmation or details to send a message to the recipient or others informing him/her of your Order. This feature is provided free of charge. We may modify or terminate the use of such alerts at any time. However, the Mobile App/Website does not commit to keeping your message private or confidential. By using sharing options, you acknowledge that the Mobile App/Website is providing the technical functionality only, and that you are solely responsible for the content of your messages. The Mobile App/Website undertakes no duty to monitor any messages sent by you. However, the Mobile App/Website, in its sole discretion, may elect, but is not obligated, to look at your messages to protect itself.

      15. OUR LIABILITY:

      • Subject to the following provisions of this paragraph, our sole and entire maximum liability for any reason, and your sole and exclusive remedy for any cause or claim whatsoever shall be limited to the service charges paid by you excluding the applicable taxes as follows:
        • We shall have no liability for loss of or damage to Prohibited Items;
        • We shall not be liable to the Customer, for negligence, breach of contract or otherwise, for any indirect, special or consequential loss, nor for any losses arising from business interruption, wasted management time, loss of goodwill or loss of data, whether or not arising in the normal course of business;
        • We shall not be liable to the Customer or deemed to be in breach of the Terms And Conditions by reason of any delay in performing or any failure to perform any of our obligations under the Terms and Conditions if the delay or failure was due to any circumstances beyond our reasonable control;
        • The Customer acknowledges that the limitations of liability as set out in this paragraph are fair and reasonable in the circumstances and have been taken into account and reflected in the level of the prices charged.
        • Negligence or any act or omissions by any representative or corporate or alliance partners or logistic partners.
        • USE OF OUR MOBILE APP/WEBSITE LOCATION AND ITS CONTENT IS AT YOUR SOLE RISK. WE WILL IN NO EVENT BE LIABLE TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES UNDER ANY THEORY OF LAW FOR ANY ERRORS IN OR THE USE OF OR INABILITY TO USE OUR SERVICE AND ITS CONTENT INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, BUSINESS, DATA, LUGGAGE'S OR DAMAGE TO ANY COMPUTER SYSTEMS, EVEN IF YOU HAVE ADVISED US OR OUR REPRESENTATIVES OF THE POSSIBILITY OF SUCH DAMAGES.

        16. INDEMNITY

        You agree to defend, indemnify and hold harmless us and our representative and employees, its parent and affiliate companies and their respective officers, directors, employees, agents and representatives from any and all claims (i) arising out of your breach of any of these Terms and Conditions, and any of your activities conducted in connection with this Mobile App/Website that provides the Service.

        There are links on the Mobile App/Website that allow you to visit the sites of third parties. Neither these sites nor the companies to whom they belong are controlled by us. We make no representations concerning the information provided or made available on such sites nor the quality or acceptability of the products or services offered by any persons or entities referenced in any such sites. These third-party websites or mobile application links on our Mobile App/Website are not tested and we make no representations regarding the correctness, performance or quality of such links. You should research and assess the risks which may be involved in accessing and using such links before using it.

        18. DISCLAIMER OF WARRANTY

        THE CONTENTS OF MOBILE APP/WEBSITE ARE PROVIDED "AS IS" AND ITS REPRESENTATIVES DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANT-ABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, REGARDING ANY SUCH CONTENT AND YOUR ABILITY OR INABILITY TO USE THE MOBILE APP/WEBSITE AND ITS CONTENT. THE MOBILE APP/WEBSITE AND ITS REPRESENTATIVES EXPRESSLY DISCLAIM AND EXCLUDES ALL WARRANTIES REGARDING THE MOBILE APP/WEBSITE, EMPLOYEES AND THE FUNCTIONING OF THE INTERNET WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT OUR EMPLOYEES AND REPRESENTATIVES WILL MEET ALL OF CUSTOMER'S REQUIREMENTS OR THAT ITS OPERATIONS WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ANY DEFECT WITHIN ORDER PROCESS WILL BE CORRECTED. FURTHERMORE, WE DO NOT WARRANT NOR MAKE ANY REPRESENTATION REGARDING THE RESULTS OF CUSTOMER'S USE OF OUR SERVICES IN TERMS OF CAPABILITY, CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION, REPRESENTATION OR ADVICE GIVEN BY OUR EMPLOYEES OR REPRESENTATIVES OR AN AUTHORISED REPRESENTATIVE OF OURS SHALL CREATE A WARRANTY.

        19. GOVERNING LAW AND JURISDICTION

        • Any cause of action with respect to our Mobile App/Website or this Terms and Conditions must be instituted within 30 days after the claim or cause of action has arisen failing which it shall be time barred and must be brought before a court of competent jurisdiction.
        • This Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Karnataka and the Parties hereto irrevocably submit to the sole and exclusive jurisdiction of the courts at Bengaluru in respect of any dispute or matter arising out of or connected with this Terms and Conditions.

        20. WAIVERS:

        The waiver by either party of a breach or other violation of any provision of this Terms and Conditions shall not operate as, or construed to be, a waiver of any subsequent breach of the same or other provision of this Terms and Conditions.

        21. SEVERABILITY:

        These Terms and Conditions constitute the entire agreement between you and Travel Cloth with respect to the subject matter of these Terms and Conditions. If any provision of these Terms and Conditions is deemed unlawful, void or for any reason unenforceable by a court of competent jurisdiction, the validity, and enforceability of any remaining provisions will not be affected.
